Functional Behavior Assessments (FBAs) and Behavior Intervention Plans (BIPs)

FBAs (Functional Behavior Assessments) and BIPs/ PBSPs (Behavior Intervention Plans / Positive Behavior Support Plans) – More (& a Little Different) Information!!!

Consent to Evaluate is required when the school will use additional testing data to complete the FBA – meaning a BASC or other specific assessment. If additional testing info is not required, then a consent to evaluate is not needed. All general ed students must still go through Iteam for a FBA referral.  Regardless of how a FBA is initiated, parents must always understand what is happening and why.

Guidelines for turning in your BIPs / PBSPs include:
1.  In general, if a BIP is written for severe behavior where interventions such as using restraints, safe rooms or contacting the police are included in the plan, signatures should be gathered from team members including the parent. For all others, signatures are not required.

2.  For a BIP developed in coordination with the annual review, turn in the BIP with the other paperwork as a part of the IEP.

3.  For a BIP developed outside of the annual review, the following paperwork is needed:  Invitation to a meeting, BIP, PWN (include the wording that the BIP will be updated as needed and how that will be communicated with the parent), and a signature page if #1 above is a factor.

Cover Page Reminders – Secondary Transition

The IEP cover page has a section for parents to give consent for transition agencies to attend a student’s IEP meeting. Here are some additional guidelines that will hopefully be helpful.

1. If the student is a junior, DVR must be considered for participation in IEP meetings.

2. If, after careful consideration, no transition agencies are appropriate, there should not be a signature on the parent signature line. Instead write “Not appropriate for this meeting.”  Be sure to consider participation annually.

Ask any non-KPBSD representative present at the meeting to write the name of their agency/company on the line next to their signature or next to the word “other” under their signature line.

Changes to Initial Consent for Sped Services Form

The form for “Parent Consent for Special Education Services” has been revised in the database.  These revisions have been made to align with the sample form in the state handbook.

Checkboxes have been added to designate whether a parent does or does not give consent for special education services.  Parents should be signing this consent form at any initial eligibility meeting where the child meets the criteria to qualify for special education services.   This form should be signed after the eligibility meeting, but before the initial IEP is developed. If the child qualifies for special education, but the parents do not give consent for services, the team does not need to develop an IEP.

The changes to this form were made to make it clear that the parents are giving consent for the provision of special education services—not consent for a particular program or type of services.  Those details will be worked out by the IEP team, if and when the parent gives consent for the student to participate in special education.

Changes to Sped Main Screen – Highlighting Referrals at 45 Days

The main screen on the special ed database will now highlight students who have been in the special ed referral process for 45 days or more.  The timeline in KPBSD is 75 calendar days from the date that consent to evaluate is obtained, to the date that the ESER and IEP must be complete.

Keep in mind that the date consent is signed, counts as the first day in the 75 day count—even if the consent form is signed at 5:00 pm

This is meant to give case managers a heads up as the 75-day deadline approaches, to ensure that you have plenty of time to get a date set for your ESER/IEP meeting and complete the process within the required time frame.

The system will also highlight referrals who are missing either of the consent dates on the “Referral Info” screen.  If one of your students is highlighted, and you feel you are still under 45 days, please double check to make sure that both consent dates have been entered into the database (see below).

Transition IEP Cover Page – Consent for Outside Agency Participation

The following text has been added to the IEP cover page for transition age students:

The district must obtain parental consent regarding transition agency participation.  (Checkbox) I give my consent for the following agenc(ies) to participate. (Checkbox) I do not give my consent for the following transition agenc(ies) to participate.

At  Friday’s transition training, the question came up as to how to document consent for students with more than one outside agency involved in the transition process. In some instances the family may wish to include one agency and not another. This new text will allow case managers to document which agencies the parent gives consent for participation, and which (if any) the parent does not provide consent for.

The text below has also been added to the printed meeting invite for transition age students:

Note: Districts must invite transition agenc(ies), as appropriate, if a student is at transition age.  Please notify your child's case manager as soon as possible if you do not wish for the transition agency to participate in the meeting.

 

 

Please keep in mind that if an outside agency is included in a student’s transition plan, that agency should be invited to participate in the IEP meeting and must be included on the meeting invite. If the parent (or 18 y.o. student) chooses not to give consent for agency participation, we have met our obligation by inviting the agency.  Either way, the parent (student) needs to sign the consent section of the IEP cover page to indicate that they do or do not give consent.  Please use caution when including outside agencies as the provider for transition services if/when those agencies are not active participants in the IEP meeting.
